I. RECOMMENDATION:
It is recommended that the City Council reject the claim for damages presented by Leo Trevino.
II. BACKGROUND:
Mr. Trevino filed a claim with the City of Coalinga (see attached) on February 9, 2023. The claim was sent to George Hills Company for review. After review and investigation of the claim it was determined the City’s Public Works received calls from residents for backups in the Harvard and University alleys, but they checked the City’s main line and the main was running fine.
III. DISCUSSION:
Our investigation revealed that claimant’s backup issues resulted from a blockage in their sewer lateral. Per Resolution No. 3961 adopted policy regarding owner responsibility for sewer laterals and the homeowner is responsible for their lateral all the way to their connection to the City’s main line with the City taking responsibility at the main line. Therefore, George Hills Company recommends the claim be rejected at this time.
IV. ALTERNATIVES:
Accept the claim for the requested dollar amount (staff does not recommend).
V. FISCAL IMPACT:
The fiscal impact will be determined by Council decision. |
