STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE AUTHORITY

Subject:Notice of Completion for Polk Street Emergency Repairs Project No. 3022
Meeting Date:Thursday, March 16, 2023
From:Marissa Trejo, City Manager
Prepared by:Sean Brewer, Assistant City Manager

I.    RECOMMENDATION:

It is recommended that the Coalinga City Council:

A. Accept the project as complete.

B. Authorize the City Engineer to file the Notice of Completion for the project with           the County Recorder and notify surety to exonerate contract bonds.

C. Authorize the Finance Department to release the 5% construction retention payment to Witbro, Inc. DBA Seal Rite Paving & Grading 35 days after recordation of the Notice of Completion by the Fresno County

Registrar-Recorder’s Office, contingent upon no claims being filed on the project.

II.    BACKGROUND:

On February 2, 2023, the City Council approved proceeding with Informal Bidding Procedures under an Emergency Work Amendment amended to Ordinance No. 857 Chapter 8 of Title 7 Municipal Code to provide emergency work procedures under the Uniform Public Construction Cost Accounting Act.

The work to be done under this Amendment is to repair damages that occurred on December 29th. An 8” water main beneath E Polk undermined and destabilized the road in such a way that made it unsafe for vehicular traffic.  The area was large enough to render the work unable to be completed by City staff.

During the January 19th City Council Meeting, a resolution was passed to proceed with emergency repairs.  As a future agenda item, Councilman Hedgcock requested a more expedited method to complete emergency work.

Section 22031 of the California Public Contract Code allows for alternative procedures to complete work outside of the standard informal bidding procedures.  Section 22035 specifically allows for emergency work to be completed without  adopting plans, specifications, or giving notice for bids.  It calls out Section 22050 as to what that procedure should be.

III.   DISCUSSION:

An Agreement was signed by Seal Rite Paving on January 30, 2023 for an estimated $23,919.00 providing 15 working days to complete construction.

The project was completed on February 17, 2023.

The project repaired approximately 570 square feet of 3 inch section of AC pavement at Forest and Polk and approximately 1,550 square feet on Polk between 6th and Glenn. It also includes applicable markings and striping. Seal Rite Paving’s final invoice was $27,824.79 which included the actual amount of Hot Mix Asphalt Type A needed.

A final inspection of the project was performed February 17, 2023, and Polk Street was opened to traffic later that same day.  The notice of completion, when filed, begins a time period for which mechanics liens, liens against the contractor, and stop payment notices can be filed against a public construction project. It is a protection for the City during a construction project. Staff is not aware of any issues related to this project.

IV.   ALTERNATIVES:

None.

V.    FISCAL IMPACT:

The project was fully funded by water enterprise funds and is unbudgeted.

There is no fiscal impact to the General Fund.
