I.    RECOMMENDATION:

It is recommended that the Coalinga City Council award a Contract in the amount of $231,218.01 to American Asphalt South, Inc. for the Resurfacing Project Phase 3. It is also recommended that a contingency of 10% ($23,121.80) be included in the Council action to cover any unforeseen incidentals for a total authorization amount of $254,339.81.



II.    BACKGROUND:

On January 8, 2026, Council Authorized the Construction Phase to proceed for the Resurfacing Phase 3 Cape Seal Project.

III.   DISCUSSION:

City Staff received and opened four (4) bids for this project on 4/22/2026, at 2:00pm. American Asphalt South, Inc. was the apparent low bidder with a total bid proposal of $231,218.01.

 

Subsequent to the bid opening, the City received a formal protest from VSS International, Inc. challenging the responsiveness of the apparent low bidder. Under California law, a bid may be rejected as nonresponsive only where a deviation is material. Minor irregularities that do not affect price, give a competitive advantage, or impair enforceability may be waived. Staff has determined that the issues identified in the protest constitute minor irregularities that are waivable.

 

The Engineer’s Estimate was $434,538.00. The entire bid summary is included as Attachment “A”. American Asphalt South, Inc., has furnished the required bid bond. The bid bond is valid and enforceable as submitted. If the City Council decides to award the project to American Asphalt South, Inc., and the ”Notice to Proceed” is issued, the Contractor will have Thirty (30) working days to complete the work. The following is a tentative schedule:

 

Award of Contract:                     May 7, 2026

Start of Construction:                June 1, 2026

Completion of Construction:    July 10, 2026

IV.   ALTERNATIVES:

  • Accept American Asphalt South Incorporated's bid (Recommended)
  • Reject all bids and re-advertise or cancel the project; it is unlikely that re-advertising the project will result in lower bids. (Not Recommended)


V.    FISCAL IMPACT:

Total authorization request for this contract is $231,218.01 with an additional 10% contingency of $23,121.80 for a total of $254,339.81.  This project is funded by TDA Street Maintenance Funds.

 

There will be no fiscal impact to the General Fund.
