I.    RECOMMENDATION:

Staff recommends adoption of Resolution No. 4074, approving the acceptance of real property located at 131 E. Cedar Avenue, Coalinga, CA (APN: 072-111-12) and further authorizing the City Manager to sign all necessary documents to accomplish said acceptance. 

II.    BACKGROUND:

The City is interested in purchasing a property located at 131 E. Cedar Avenue, Coalinga, CA 93210 for a purchase price of Seventy Thousand and No/100 dollars ($70,000). The property is currently owned by Israel Trevino and Mercedes Trevino. 

 

The property would be used for a future splash pad and would benefit the residence of the City. 



III.   DISCUSSION:

The acceptance of real property is not a project, per California Public Resource Code (PRC) Section 21065 and is therefor exempt from CEQA. 

 

PRC Section 21065 states: "Project" means an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and which is any of the following: 

 

(a) an activity directly undertaken by any public agency. 

 

(b) an activity undertaken by a person which is supported, in whole or in part, through contracts, grants, subsidies, loans, or other forms of assistance from one or more public agencies. 

 

(c) an activity that involves the issuance to a person or a lease, permit, license, certificate, or other entitlement for use by one or more public agencies. 

 

This activity will not cause a direct physical change in the environment and it will not cause a reasonably foreseeable indirect physical change in the environment. No development is proposed through this activity, and all zoning and general plan designations will remain the same. The result of this activity will be limited to legal ownership of property and any/all environmental factors that exist now will remain the same once the activity is completed. Any future development of said property would be considered a project and would be subject to CEQA review at that time.

The purchase price of the property is Seventy Thousand and No/100 Dollars ($70,000).
